These Terms and Conditions set out the basis on which Rubbish Removal Tufnell Park provides waste collection and related services to residential and commercial customers. By placing a booking, confirming a quotation or allowing our team to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following words have the meanings given to them:

Customer means the person, business or organisation requesting our services.

Services means any rubbish removal, waste clearance, waste collection, loading, transport and disposal services supplied by us to the Customer, including any additional related services agreed in writing.

Waste means any rubbish, junk, household waste, garden waste, commercial waste or other materials to be removed as part of the Services.

Site means the property or location at which the Services are to be carried out.

We, us and our means the provider trading as Rubbish Removal Tufnell Park.

2. Scope of Services

We provide rubbish removal and waste collection services within our designated service area, which includes Tufnell Park and surrounding localities. The exact scope of the Services for each booking will be set out in our quotation or booking confirmation.

Unless expressly stated otherwise, our Services include the loading of Waste onto our vehicle, transportation and lawful disposal or recycling at a licensed waste facility. We do not provide building, demolition or cleaning services, and we are not responsible for disconnection of utilities or fixtures unless specifically agreed and carried out by qualified personnel.

3. Booking Process

3.1 You may request a booking by telephone, email or other contact methods we make available. You must provide accurate information about the type, approximate volume and location of the Waste, access details to the Site and any relevant restrictions such as parking or time limits.

3.2 Any quotation we provide based on your description of the Waste is an estimate only. The final price may be adjusted on arrival if the actual type, weight or volume of Waste differs from your description, or if access is more difficult than reasonably anticipated.

3.3 Your booking is confirmed when we have agreed a date and time window for the visit and you have accepted our quotation or price estimate, whether verbally, in writing or by allowing the Services to commence.

3.4 We reserve the right to refuse or cancel a booking at our sole discretion, including where we consider the Waste to be hazardous, where access is unsafe, or where carrying out the Services would breach any law or regulation.

4. Access and Customer Obligations

4.1 You must ensure that we have safe, reasonable and lawful access to the Site and to the Waste at the agreed time. This includes arranging any necessary parking permissions, permits, loading bay access or gate codes, and ensuring that the access route is clear and reasonably free from obstruction.

4.2 You are responsible for securing any consents required from the property owner, managing agent, local authority or other third parties for us to attend the Site and remove the Waste.

4.3 You must ensure that the Waste is clearly identified and is not mixed with items you wish to keep. Our team will remove only the materials that you indicate are to be taken. We are not liable for the removal of items that you failed to separate or identify correctly.

4.4 You must inform us in advance of any special risks at the Site, including but not limited to the presence of asbestos, clinical waste, chemicals, sharp or dangerous objects, structural instability or any other health and safety hazards.

5. Waste Types and Prohibited Items

5.1 We operate in accordance with applicable UK waste legislation and hold or work under appropriate waste carrier authorisation. We will remove only those types of Waste that we are legally permitted and properly equipped to handle.

5.2 Certain items are hazardous or require specialist disposal methods. These may include, without limitation, asbestos, clinical or medical waste, certain chemicals, oil, fuel, gas cylinders, pressurised containers, some electrical items containing refrigerants, and other regulated materials. We reserve the right to refuse removal of such items or to apply additional charges if specialist handling or disposal is required.

5.3 You confirm that the Waste to be removed is your property or that you have the authority of the owner to arrange for its removal and disposal. You will indemnify us against any claim brought by a third party arising from the removal of Waste you instructed us to take.

6. Pricing and Quotations

6.1 Our pricing is typically based on the volume and type of Waste, the weight where applicable, the time required to carry out the clearance, ease of access and any disposal or recycling fees charged by licensed facilities.

6.2 We may provide a quotation following a site visit, description by phone, photographs or other information you supply. Any quotation will state whether it is a fixed price or an estimate subject to confirmation on arrival.

6.3 Additional charges may apply for difficult access, excessive loading distances, items requiring extra labour or dismantling, or any waiting time beyond a reasonable allowance caused by delays outside our control.

7. Payments and Invoicing

7.1 Unless otherwise agreed in writing, payment is due in full on completion of the Services on the day of collection. We may accept payment by cash, bank transfer, card or other methods notified to you.

7.2 Where we agree credit terms with a commercial Customer, payment shall be made within the period stated on our invoice. If no period is stated, payment will be due within 14 days of the invoice date.

7.3 If you do not pay on time, we reserve the right to charge interest on late payments at the statutory rate applicable in England and Wales, and to recover any reasonable costs incurred in collecting the debt.

7.4 We may require a deposit or pre-payment for certain bookings, such as large clearances, out-of-hours work, or where skip hire or specialist services are required. Any deposit will be offset against the final invoice.

8. Cancellations and Amendments

8.1 You may cancel or amend a booking by contacting us as soon as possible. Cancellations or significant changes made less than 24 hours before the agreed arrival window may incur a cancellation fee, especially where we have allocated a vehicle and team specifically for your job.

8.2 If we arrive at the Site and are unable to carry out the Services due to a lack of access, absence of an authorised person to provide instructions, or other reasons outside our control, we may charge a call-out or aborted visit fee to cover our costs.

8.3 We may cancel or reschedule a booking if we are unable to attend due to vehicle breakdown, staff illness, extreme weather, safety concerns or other circumstances beyond our reasonable control. In such cases, we will aim to offer an alternative date as soon as reasonably practicable and shall not be liable for any indirect loss resulting from the delay.

9. Performance of the Services

9.1 We will perform the Services with reasonable care and skill, using suitably trained personnel and appropriate equipment for the job.

9.2 Any time or date for completion of the Services is an estimate only. Arrival and completion times may vary due to traffic, access conditions or previous jobs taking longer than expected. We will use reasonable efforts to keep you informed of any significant delays.

9.3 Our team may refuse to move items where doing so would, in their reasonable opinion, create an unacceptable risk of damage to the property or personal injury. You may request that we proceed at your own risk, but we reserve the right to decline such requests for safety or insurance reasons.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be limited or excluded under UK law.

10.2 Subject to the above, our total liability to you for any loss or damage arising out of or in connection with the Services shall not exceed the total price paid or payable for the relevant booking.

10.3 We are not liable for indirect or consequential losses, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of data, whether arising in contract, tort or otherwise.

10.4 You are responsible for protecting flooring, walls, staircases and other surfaces if you are concerned about scuffs or minor marks arising from normal manual handling activities. We will take reasonable care when carrying Waste through the property, but we are not liable for minor cosmetic damage that is reasonably associated with the Services.

10.5 We are not liable for any items that you intended to retain but which were removed because they were not clearly separated from, or were mixed in with, the Waste. It is your responsibility to set aside and safeguard items you wish to keep.

11. Ownership of Waste and Environmental Compliance

11.1 Once the Waste has been loaded onto our vehicle and the Services have been completed, ownership and responsibility for the Waste transfers to us. We will handle and dispose of the Waste in compliance with applicable UK waste management regulations.

11.2 We will use licensed waste transfer stations, recycling facilities and disposal sites, and will aim to divert as much Waste as reasonably possible from landfill, subject to the facilities available and the nature of the materials collected.

11.3 We may issue a waste transfer note or similar documentation where required by law. You should retain any such documentation for your records, particularly if you are a commercial Customer with statutory responsibilities in respect of waste.

12. Customer Data and Privacy

12.1 We may collect and store your contact details, booking information and payment information in order to manage your booking, process payments and keep appropriate business records.

12.2 We will handle personal data in accordance with applicable data protection laws. Your details will not be sold to third parties. We may share information with service providers who assist us in operating our business, including payment processors and waste facilities, where necessary for the provision of the Services.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible, preferably on the day of service or within 48 hours of completion. We may request photographs or further information to assess the issue.

13.2 We will seek to resolve complaints promptly and fairly. Where appropriate, we may offer a partial refund, re-visit or other reasonable remedy, taking into account the nature of the complaint and the circumstances of the job.

14. Changes to These Terms

14.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking.

14.2 Any significant changes will be made available through our usual communication channels. Continued use of our Services after any update indicates your acceptance of the revised terms.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Removal Tufnell Park.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if such modification is not possible, deleted. The remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy provided by law or under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

16.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations at any time, provided that this does not materially affect the standard of the Services.

16.4 These Terms and Conditions, together with any accepted quotation or written agreement, constitute the entire agreement between you and us in relation to the Services and supersede any prior discussions, correspondence or understandings.
